The public property registry (It´s the institute that is in charge of registering legal acts relating to real estate). If there is a dispute between the owner before the land registry office and the cadastre office, the latter’s decision will be applied.
However, this does not mean that it is no longer important to verify who the cadastral titleholder is if you wish to acquire a property. The same person should normally appear as the title holder before the two agencies mentioned above. Therefore, if there is any discrepancy, it is an indication that something needs to be checked.
The suitable document by means of which the public land registry informs who the owner of a property is, is the certificate of freedom of encumbrance. It is advisable to make decisions on the basis of what this official document reports, and not on the basis of information that “the screen” of the search system may give us. Sometimes there are discrepancies.
The key piece of information to search for a property in the public property register is the “folio real” (real folio). It is therefore advisable to ask the seller for this information when you are interested in acquiring a property.
