Does not having money means being at a disadvantage when it comes to keeping your children?

No. Children should be “with whom they can have their best development”, regardless of whether that person has money or not. how do we know with whom they will have their best development? This will depend on the particularities of the specific case, and of course on the characteristics of the parents.

Let’s take as a case of analysis a family of 3: mother, father and daughter. The agreed dynamics in this family is that the mother is dedicated to financially activities, and the father is dedicated to taking care of the home. They split up, and evidently the one who will have more economic power after the separation is the mother.

In normal situations, in a case like this, it could be considered that the daughter will have a better development with the father. Because according to the family roles, he is the one who has been in charge of her, and who has more time to take care of his daughter. Since the mother must dedicate a significant part of her time to income-earning activities in order to earn a living.

But of course this can change if the father turns out to be a bad person. In that case, even if the mother has less time to spend with her daughter (because she is engaged in income-earning activities), the child will undoubtedly have a better overall development being in her mother’s care.

Another case could be that the mother’s income is no longer enough to cover her daughter’s needs. Either because her daughter needs have increased, or because the possibility (income) has decreased. In this situation, the father will have to dedicate time to an income-earning activity in order to be able to contribute to cover his daughter’s needs. The obvious consequence of this is that the father will have less time to devote to his daughter, and (in normal situations) the father will no longer have preference in caring for his daughter.

If the parent with whom the child will have a better development (taking into account the particularities of the case), is not the one who performs the economically remunerated activities, or performs them with less income, he/she has the right to ask for money from the party who generates the income (or generates it to a greater extent).
